- Bidders will register and obtain a Bidder's number
to be used at this Auction.
- On the Auctioneer's call of "SOLD," the
highest Bidder will be the purchaser. In the event
of any dispute between two Bidders or in the event
of doubt on our part as to the validity of any bid,
the Auctioneer will have the final discretion to determine
either the successful Bidder or put the item on the
block and resell it. If any dispute arises after the
sale, Aria Auction Gallery, Inc.'s sales record shall
be conclusive as to who was the purchaser, the amount
of the highest bid, and in all other respects.
- All property is sold "As Is - Where Is."
Aria Auction Gallery, Inc. makes no guarantees, warranties,
or representations expressed or implied and waives
expressed or implied warranties and representations
with respect to the property or the correctness of
this catalogue or the description of the authorship,
physical condition, size, quality, rarity, importance,
provenance or otherwise. Aria Auction Gallery, Inc.
makes no guarantees, warranties or representations
as to any represented value, whether oral or written
shall be deemed such a guarantee, warranty, or representation.
Prospective Bidders are encouraged to inspect closely
the property being sold prior to bidding to determine
its condition, size, and whether or not it has been
restored or repaired, and to determine through the
inspection, the items to be acceptable quality and
value separate and distinct from any representation
by Aria Auction Gallery, Inc. personnel.
- While many items in the Auction will be sold without
reserve, the Auctioneer withholds the right to bid
on behalf of each consignor for the purpose of protecting
reserves, that is, placing bids during the Auction
if and when the highest outstanding bid is less than
the reserve on the lot being offered.
- Payments must be made on the day of purchase. Cash,
certified checks or personal checks will be accepted.
Checks must be accompanied by a major credit card
and a current driver's license. Parties unknown to
Aria Auction Gallery, Inc. may be required to provide
further information and submit a deposit toward purchases
during Auction.
- On the Auctioneer's call of "SOLD," title
will pass to the highest Bidder, as acknowledged by
the Auctioneer, subject to the Bidder fulfilling all
the conditions set forth herein. The Bidder assumes
full risk and responsibility and agrees to pay the
full purchase price.
- Aria Auction Gallery, Inc. is not responsible for
the acts or omissions of the carriers, delivery services
or packers of the purchased lots whether or not recommended
by us. Packing and handling of purchased lots by Aria
Auction Gallery, Inc. employees is at the entire risk
of the purchasers and in no event will Aria Auction
Galleries, Inc. be liable for any damage to glass
or frames regardless of the cause.
- This is a privately owned and operated Auction.
We reserve the right to refuse admittance to any person
for any reason or eject from the Auction site anyone
selling or attempting to sell their own merchandise
or creating a distraction or disruption during the
Auction.
- We reserve the right to withdraw any item prior
to the Auction without notice.
- In no event does Aria Auction Gallery, Inc. liability
to purchaser ever exceed the purchased price actually
paid.
- Unless special arrangements have been made, all
purchases must be removed from the premises within
one day. After this period, Aria Auction Gallery,
Inc. will not be responsible for lost or damaged merchandise,
and no refunds will be made if lost or damaged.
- Neither the Seller or Auctioneer assume responsibility
for injuries suffered while inspecting or buying.
